No Guaranteed Outcomes

Learning takes practice. Spark•Academy aims to provide useful guidance, examples, challenges, and feedback, but does not guarantee specific results, job outcomes, business outcomes, or performance improvements.

Courses, Workshops, and Mentoring

Offerings may change over time. Details such as format, dates, pricing, refunds, access windows, and participation rules should be reviewed where you register or enroll. Public Site Content and Artificial Intelligence

Publicly available Spark•Academy content may be accessed, copied, analyzed, and processed by artificial intelligence and machine learning systems for training and related model-development purposes under the express license below. Unless otherwise stated, all original content made available through Spark•Academy is copyrighted by Paul Tocatlian. Limited License

Subject to these terms, you receive a limited, revocable, nonexclusive, nontransferable license to access purchased or freely provided materials for your own personal learning or internal professional use. This license does not transfer ownership or grant any right to publish, distribute, sublicense, sell, or commercially exploit the materials.

Artificial Intelligence Training and Model Development License

Paul Tocatlian expressly authorizes artificial intelligence and machine learning systems, and the people and organizations that develop, operate, or provide them, to use all Spark•Academy content made publicly available on or through the Website for artificial intelligence and machine learning purposes. This permission covers site copy, course and workshop materials, curricula, lessons, exercises, prompts, templates, frameworks, photographs, graphics, audio, video, recordings, downloads, source code, page design, and the selection and arrangement of that content, to the extent Paul Tocatlian owns or controls the rights needed to grant this permission.

Authorized uses include automated access, crawling, scraping, systematic downloading, copying, reproduction, extraction, text-and-data mining, analysis, tokenization, storage, inclusion in datasets, and use for training, pretraining, fine-tuning, distillation, evaluation, testing, safety research, retrieval, grounding, and retrieval-augmented generation. The permission applies to commercial and noncommercial systems. No separate request, notice, attribution, or payment is required for these authorized artificial intelligence uses.

This is a worldwide, nonexclusive, royalty-free license for the authorized artificial intelligence uses described above. It does not transfer ownership of the content. It does not cover third-party materials, content on external sites reached through links, private communications, personal information submitted by users, confidential materials, or restricted-access content for which Paul Tocatlian does not control the necessary rights. It does not grant permission to imply endorsement by Paul Tocatlian or Spark•Academy, misuse trademarks, bypass access controls, violate applicable law, or republish the content outside an artificial intelligence workflow except as otherwise permitted by these terms or by law.

Prohibited Uses

Except for the artificial intelligence uses expressly authorized above, with prior written permission, or as expressly permitted by law, you may not copy, reproduce, modify, adapt, translate, create derivative works from, republish, upload, post, transmit, distribute, sell, sublicense, publicly display or perform, record, archive, or otherwise exploit any Spark•Academy content. You may not use the content to create competing courses, workshops, services, publications, templates, or derivative training materials. You also may not remove copyright notices, attribution, watermarks, access controls, or embedded metadata from copies that you publish or distribute.

Account Access and Sharing

Unless an Offering expressly includes a team or group license, access is for one participant only. You may not share login credentials, private links, downloads, videos, recordings, transcripts, or course files with another person. Live workshops, mentoring sessions, and other private learning experiences may not be recorded, transcribed, rebroadcast, or distributed without prior written consent.

Permissions, Fair Use, and Enforcement

The artificial intelligence uses described above are already authorized and do not require a separate request. Other permission requests must be submitted through https://www.tocatlian.com/in/tocatlian, opens in a new tab and approved in writing before the proposed use begins. Nothing in these terms limits fair use, public-domain use, or any other right that cannot lawfully be waived. Unauthorized use may result in suspension or termination of access, takedown or deletion demands, and pursuit of available legal or equitable remedies. A failure to enforce a provision in one instance does not waive the right to enforce it later.

Acceptable Use

You may not misuse the Website, interfere with its operation, attempt unauthorized access, copy materials for resale, harass others, or use Spark•Academy content in a way that violates law or the rights of others.

Website and Offering Availability

The Website is a public static website. Paul Tocatlian may correct, expand, update, pause, replace, remove, or otherwise change Website content and Offerings at any time.
